Z-Visum / S1 Visum für China

Der lange Weg zum Z-Visum / S1 Visum und der finalen Residence Permit

Unser Firma hat einen sonderbaren Weg eingeschlagen und uns mit einem normalen Business Visum nach China geschickt. Neben dem Vergnügen, alle 30 Tage ins asiatische Ausland reisen zu dürfen, gab es auch eine kleine Schattenseite: unser Container konnte nicht verschifft werden und stand gut drei Monate in Bremen rum. Ohne eine chinesische Residence Permit mit min. 365 Tagen Restlaufzeit (wichtig: ab Stempel des Exit Entry Bureau – also eine Residence Permit für min. 1 Jahr und 3 Wochen beantragen!) kann der Container nicht durch den chinesischen Zoll.

Im Regelfall läuft der Visa-Prozess folgendermaßen ab:

  1. Gesundheitscheck (chinesisches Formblatt), Röntgenbilder der Lunge, EKG (Ausdruck beilegen), Blutbild, alles ausfüllen und über das Bild vom Arzt mit rotem Stempelkissen (mitbringen) abstempeln lassen
  2. Heiratsurkunde, polizeiliches Führungszeugnis beantragen und direkt weiterschicken für die maximale Überbeglaubigung / Apostille
  3. Hochschulzeugnisse, Arbeitszeugnisse, Lebenslauf und Pässe zusammen suchen – natürlich im Original!
  4. alles in einen versicherten Umschlag und ab nach China
  5. In China die Personalabteilung mit den Unterlagen aus Schritt 1-3 die Employment License beantragen lassen, das ist die Arbeitserlaubnis für China. Hierfür werden zahlreiche Übersetzungen notwendig und noch ein paar weitere offizielle Formulare (Nachweis Arbeitserfahrung, Grund der Anstellung, usw. – siehe unten)
  6. Im Anschluss noch ein offizielles Einladungsschreiben vom Arbeitsministerium anfordern
  7. Alles zurück in den Umschlag und ab nach Deutschland, dort dann persönlich nach Frankfurt zur Visa Stelle der chinesischen Botschaft und das Z-Visum beantragen.

Wir haben die Schritte 1-4 einfach mal übersprungen und sind direkt nach China geflogen. Im Januar durften wir dann nach Seoul, im Februar nach Hongkong und im März nach JeJu Island. Erst im April waren alle Unterlagen übersetzt und die Employment Licence fertig, sodass wir nach Frankfurt fliegen konnten. Ein Hinweis – dort nicht zum Generalkonsulat in die Stresemannallee gehen sondern zur Visa-Stelle in der Bockenheimer Landstraße! Dort alles abgeben und dann gute fünf Arbeitstage warten, bis das gute Z1-Visum fertig ist. Dann ging es wieder nach Tianjin, dort erneut zum Medical Check (alle Unterlagen aus Deutschland wurden anerkannt – wir waren in der Tropenklinik in Tübingen (~250€ p.P) – und dann endlich zum Exit-Entry Bureau um das Z1-Visum in eine Residence Permit umzuwandeln.

In Summe hat alles zusammen mit sinnlosen Flügen (3 Ausreisen + Rückflug Frankfurt) für zwei Personen gut 13.000€ gekostet (inkl. 85h Zeitaufwand meinerseits). Nett! Und ich dachte ich soll in China ein Werk aufbauen 🙂

Hier noch Tipps & Tricks:

  • Passbilder gibt es billig in den meisten chinesischen Ämtern
  • In Frankfurt in die Bockenheimer Landstraße zur Visa-Stelle gehen
  • Wer in Frankfurt wartet – Messezeit beachten (kaum Hotels unter 150€)!
  • Ohne gute chinesische HR Abteilung oder eine Agentur würde ich nicht anfangen

According to the Administrative Measures for Employment of Foreigners in China (laobufa [1996] No. 29), employers wishing to employ a foreign national in China need to go to the related Administrative Center for Employment of Foreigners to obtain the Employment License of the People’s Republic of China for Foreigners (hereinafter referred to as “work license”)

Documents required for company work license

  • Application form for foreigner’s employment in China
  • Employee’s resume (in Chinese, stamped)
  • Certificate of employee’s work experience
  • Report of reasons of employment
  • Proof of capability of the employee
  • Employee’s degree certificate
  • Other legal documents required by related authorities (foreigner permits application IC card issued by the Labor Bureau; stamped copy of business license; stamped copy of corporate code certificate)

After the employer successfully obtains the license, the employee needs to go to the Chinese Embassy in their home country to obtain a Z visa. The Z visa is only a vehicle to enter China for a limited period of time. Upon arrival, the Z visa holder must then obtain work and residence permits which will allow them to legally work in the country.

Documents required for a Z visa

  • Visa application form (with one recent visa photo affixed to the application form)
  • Passport
  • Invitation letter from the employer
  • Work license

Upon entering China, the foreign employee has to go to the entry and exit inspection and quarantine center to do a health check. After the employee obtains the health certificate, the employer has to go to the related Administrative Center for Employment of Foreigners to apply for a work permit. If the foreign employee is hired in China and is required to go back to their home country to apply for a Z visa, the individual is advised to get the health check prior to returning to the home country for the visa application.

Documents required for work permit

  • Copy of the employment registration form of foreign employees in China (x2)
  • Copy of the work license from the Labor Bureau
  • Copy of labor contract
  • Valid passport and visa (original)
  • Copy of passport and visa
  • Copy of health certificate
  • 2-inch photo of employee (x3)
  • Copy of the registration form of temporary residence
  • Employee’s Chinese name
  • Foreigner permit application IC card issued by the Labor Bureau

After the issuance of the work permit, the employee shall be able to go to Exit-Entry Administration Bureau of the local public security bureau to apply for their residence permit.

Documents required for residence permit

  • Employment registration form of foreign employees in China
  • Work permit (original)
  • Visa and residence permit application form
  • 2-inch photo of employee (x1)
  • Original registration form of temporary residence and its copy
  • Original passport and visa
  • Original health certificate
  • Letter of application from the employer with company stamp
  • Original business license and a stamped copy
  • Original corporate code certificate and a stamped copy
  • Certificate of approval of business

After reviewing the application, the Exit-Entry Administration Bureau of the local public security bureau will deliver the passport back to the employee with the residence permit affixed inside.
